Prior authorization for the return of an item has no legal existence.

If the return results from the implementation of the legal right of withdrawal and if the customer sends a legal withdrawal form or clearly informs the seller of his withdrawal, the seller cannot refuse the return (article L. 221-21 of the Consumer Code). However, the customer has an interest in making arrangements with the seller (prior warning from the seller) so that the return takes place under the best conditions (eg: postal address specific to returns, return label, protection and insurance of the package).

Apart from the reasons for return provided for by law or beyond the legal withdrawal period, the seller may contractually require a return procedure and therefore refuse a return that has not been made according to this procedure.

In all cases, the customer must:

  • the consumer is involved, or
  • a third party to the contract is involved, that this is insurmountable and that it was unforeseeable (a theft for example), or
  • the absence of delivery is the consequence of a force majeure (natural disaster, fire, etc.).

Note that the carrier is not considered a third party to the contract.

The client must:

  • make reservations by describing the problem on the delivery slip in the presence of the carrier if possible,
  • and inform the carrier in writing, with a copy to the seller.

  • the consumer is involved, or

Can AMG Desing Export refuse the return of an item that has not been the subject of a prior authorization request?

However, the reimbursement may be limited to the costs that the customer would have paid if he had chosen the standard delivery offered by the seller (article L. 221-24 of the Consumer Code).

If AMG Design Export grants a extension of the right of withdrawal we are entitled to do not refund the initial shipping cost .
